AGREEMENT AND RELEASE FROM LIABILITY

This Agreement and Release from Liability entered into by Marty Stevens and the Poppy Mountain Bluegrass Festival and

Hereinafter the "Operator".

WHEREAS. Marty Stevens hosts on his private property the Poppy Mountain Bluegrass Festival and, as part of the festival activities, permits individuals attending the Festival to operate four-wheel-vehicles (hereinafter called "Four Wheelers") on the festival grounds during the Festival.

WHEREAS, Marty Stevens and the Poppy Mountain Bluegrass Festival desire to restrict on the use of Four-Wheelers during the Festival.

WHEREAS, the Operator desires to operate a Four-Wheeler during the Festival
THEREFORE, the parties agree as follows:

1. The rules for use of Four-Wheelers during the Festival are as follows:

A - An The Operator must be at least 16 years of age. If not 18 years of age, parent or legal guardian must also sign this agreement.

B - The Operator shall not operate the Four-Wheeler while impaired by the use of alcohol, drugs, or other intoxicants. Furthermore, the Operator may not use alcohol, drugs or other intoxicants while operating a Four-Wheeler.

C - At no time may the Operator have the Four-Wheeler in the stage area of the Festival.

D - No double riding. Each Four-Wheeler is to carry only the Operator.

E - No riding after midnight.

F - The Operator shall follow all the Kentucky Motor Vehicle laws and regulations.

G - The Operator shall use all standard safety gear.

2. The Operator must obtain a license from the Festival Coordinator prior to operating the Four-Wheeler. The license is not transferable. If another Operator will be using the same Four-Wheeler, the other Operator must have his or her own license. The license is valid until revoked.

3. Marty Stevens and Poppy Mountain Bluegrass Festival will not charge the Operator for the license or for the privilege of using the Four-Wheeler on the Festival grounds.

4. The Operator shall be responsible for any personal injury to Operator or any other person(s) and for any property damage which results from his/her use of the Four-Wheeler. Furthermore, the Operator shall assume all liability and hold Marty Stevens and the Poppy Mountain Festival free from any liability. The Operator shall indemnify Marty Stevens and the Poppy Mountain Bluegrass Festival for any damage or injury caused by the Operators use of the Four-Wheeler.

5. Marty Stevens and the Poppy Mountain Bluegrass Festival may revoke the Operator's license and the privilege of using the Four-Wheeler on the Festival grounds if the Operator violates the rules established in this Agreement and/or any additional rules posted on the Festival grounds. If the Operator fails to surrender the license and to cease using the Four-Wheeler upon request, then Marty Stevens and the Poppy Mountain Bluegrass Festival can confiscate the Four-Wheeler. The Four-Wheeler will be returned at the conclusion of the Festival.
